Mind you, 16 months ban is quite a stretch....
Reminds me of the time I was explaining myself to my old section Sgt. what it was like to be banned for 6 months and have 9 points on the fresh license for speeding offences comitted after the 'big' one.
And you thought the feds' had no sense of humor !!!!!!!!!

If he was in a car park, in the middle of no-where, in the dead of night, then maybe he should've got a bollocking, but on a public road, over twice the limit, he should've got 16 months inside, not 16 months ban.

think yourself lucky, 1983 first offence 131mph banned 2 yrs fined £750, 14 days to pay or 6 months in the pokey. paid the fine went to work in the states, ban dont count outside the uk Very Happy Very Happy Very Happy

Well, I guess it's like the old chestnut of a car needing to display a tax disc provided that some major part of the vehicle is not missing.... ie, you cant secure a prosecution if a major component is missing as it ceases to be a road going vehicle or, the loophole (prob now closed) of whether the entrance to a car park is shared for in and out traffic or if there are 2 defined routes not shared by in and out traffic effecting the status of that car park as a public highway.

Mind you, I've been out of it for 8 years so my info is prob well out of date...

No, what i mean is that this happens, in principle every day.

A public place is a place to which the public have access to on payment or otherwise, case law stated ages ago that a car park is a public place and so the Road Traffic Act applies.
The old one entrance at one side and exit at the other doesn't apply anymore, AFAIK.

Just because its not registered or conforming to construction and use regulations doesn't mean that it isn't classified as a mechanically propelled vehicle.

So, riding a mini-moto on a car park, or a car on a car park is the same for the purpose of the RTA.

And riding on a car park and a road is the same for the purpose of the RTA.

Reminds me of when I had my driver's license revoked for 2 1/2 years. Good times Razz
None of the offenses were on a bike though. All in my hooligan car years. Ever since my car was stolen and I got my NSR, I havent had one ticket...knock on wood.

and rightly so, i beleive the law should be zero tolerance for this offence and should be changes so that you are not allowed to drink at all befor driving, IMO

The student was banned from driving for 16 months and fined £120.


For being twice the limit, thats bollocks, i got 18 months and £400 + costs for going a little too fast whilst sober, and I'd rather take my chances with someone speeding rather than twice the drink limit Smile

I agree full stop, I mean what's the bloody point! Just don't do it, unless you're in Italy where it's common place and there are no speed cameras... Rolling Eyes

And whille we're at it, what's the point of a road going vehicle being able to go over 70? I'd be happy if they all did that speed then. Bring on the GPS speedos I say!

And I wish the five-O would crack down on the C@NTS who undertake on motorways, makes me so very very mad... Evil or Very Mad But it's not just mr repmobile that does it anymore. It's mothers with 3 kids in their mum jeeps and even new drivers with their P plates! Says something about the car test I think...

That really hacks me off too, in my current motor (Mazda 6 Sport) I'll leave a gap thats just big enough for the cheecky bastards to squeeeze into and then close it up at the last minute and sit alongside them for a while so they've nowhere to go Very Happy

But there 'has' to be an allowance for people who ate some brandy covered christmas cake, unlabelled choccies at a party or just not realising how long it takes for the alcohol to get out of their system.

If the limit were 'none' in the law, there would be a helluvalot more arrests for drink driving, and in most cases this would be an unknowing and innocent intake of alcohol. There has to be a slight leeway for the genuine people that didn't realise.
