I think that the ad said no title. There are some with titles, like mine, but there is quite the premium. Like you said, no more 2 strokes in CA. I also have an NC35 for sale with CA title, but again, you pay extra for that.

Titles on 2 strokes in the US are very difficult. I have been told, but can't verify it to be true, that the 2 stroke has not been allowed by the EPA for public road use since sometime in the 70's. I can't be sure thats all states or just a select group. I was lucky and found a loop hole which worked like a charm but hard to swing.
